1. Acceptance of Terms and Conditions
Please read these terms and conditions carefully
as they apply to your use of Wharf T&T Limited’s (“WTT”) Website
(“Website”). By using this Website you agree to be bound by these
terms and conditions. If you do not accept these Terms and Conditions,
you may not and should not access any page of this Website or use
the services or information provided hereunder.
WTT may revise these terms and conditions from time to time by updating
this posting. The revised terms will take effect when they are posted.
2. Registration
You may be required to register with us via the Website before certain
Services become available to you. When you are required to register,
you undertake to:
(a) provide us with accurate, complete and updated registration
information;
(b) safeguard any user name and password which WTT provides to
you; and
(c) authorize us to assume that any person using the Website
with your user name and password is either you or is authorized to
act for you.
If you provide any other information or personally identifiable information
that is untrue, inaccurate, not current or incomplete, or WTT has reasonable
grounds to suspect that such is untrue, inaccurate, not current or
incomplete, WTT has the right to suspend or terminate your account
and refuse any and all current or future use of the Services (or any
part thereof).
2.a User Responsibility
You are solely responsible for your use of the Website. You are responsible
for maintaining the confidentiality of your account password and all
activities that occur under your account. You agree to immediately
notify us of any unauthorised use of your password or account or any
other breach of security. WTT cannot and will not be liable for any
loss or damage arising from your failure to provide us with accurate
information or to keep your password secure.
3. Services
You acknowledge that WTT may, at any time with or without notice,
(a) vary the Website or any part of the Website (including any
Sub Portal for which you are required to register); and
(b) modify, edit, omit, suspend or discontinue this Website,
any part of the Website and the services available on it.
4. Copyright and Other Intellectual Property Rights
You acknowledge that content on the Website is subject to copyright
and possibly other intellectual property rights (Intellectual Property
Rights).
You must not yourself, or participate in or permit any other
person, to:
(a) publish, reproduce, modify, distribute, publicly display,
prepare derivative works based on, repost or otherwise use any of the
content in any way, in whole or in part or in any medium for any public
or commercial purpose without our prior written consent; or
(b) otherwise infringe the Intellectual Property Rights of any
person in using the Website or any content.
Nothing you do on or in relation to the Website will transfer any
Intellectual Property Rights to you or license you to exercise any
Intellectual Property Rights unless this is expressly stated.
5. User Conduct
You must not:
(a) disrupt or interfere with the Website or servers or other
software, hardware or equipment connected to or via the Website;
(b) violate any Applicable Law relating to your use of the Website;
or
(c) collect or store personal data about other users of the Website.
6. Personal Data Statement
This Statement details WTT’s policies and practices on the collection,
use, security and access of information in accordance with the Personal
Data (Privacy) Ordinance (Cap. 486) (“Ordinance”).
You do not have an obligation to provide us with your personal data.
However the personal data WTT ask from you is necessary for us to provide
you with the Services which you have requested.
The Ordinance gives you the right to request for access and correction
of your personal data held by us.
WTT will keep your personal data confidential. Your personal data
will only be disclosed and used as described below or as agreed with
you or when required or authorised by law.
Your personal data will be used primarily to further and enhance the
relationship between you and us, including the provision to you of
our Services and products; credit reference checks; debt collection;
market research; publication of your directory details; informing you
of any of our products, Services or offers which WTT believe may be
of interest to you; prevention or detection of crime; any disclosure
required by law, compliance with a request of a competent government
authority in the course of its provision of emergency Services and
such other purposes as advised by us or agreed with you. These purposes
are also stated in the WTT General Terms and Conditions of Service.
Further, WTT may disclose your personal data to our contractors/agents
who perform certain tasks for us in connection with providing you with
our Services. WTT may also have to enter into business arrangements
with certain entities under which your personal data will be required
to be transferred to these business associates of ours. In these circumstances
these contractors/agents/associates can make no use of your data other
than for the purpose for which it was provided. WTT may also need to
disclose to other network operators in connection with the Services
that WTT provide to you. Again our arrangements with these operators
prohibit other use of your information.

In order to recover the administrative cost of acceding to your request
WTT may charge an access fee of $50.00 per request.
WTT reserve the right to amend this Statement at any time as WTT deem
necessary or as required by law.
7. The Use of the Website Is At Your Risk
WTT endeavors to provide a convenient and functional Website, but
WTT does not guarantee that the Content will be error free or that
the Website or the server that operates it is free of viruses or other
harmful components.
8. Limitation of Liability and Disclaimer
By accessing and using this Website you acknowledge and accept that
the use of the Website is at your own risk, WTT will accept no liability
whatsoever for any direct, incidental, consequential or indirect damages,
loss or corruption of data, loss of profits, goodwill, bargain or opportunity
or loss of anticipated savings, costs or expenses or any other loss
resulting from or in connection with your access to, reliance on, or
use of, or inability to use the Website and the Content, whether based
on warranty, contract, tort, negligence or any other legal theory,
and whether or not WTT know of the possibility of such damage.
8.a Linked Websites
WTT or any other Group member is not responsible for the contents
available on or the set-up of any other websites linked to this site.
Access to and use of such other websites is at the user's own risk
and subject to any terms and conditions applicable to such access/use.
By providing hyperlinks to other websites, WTT shall not be deemed
to endorse, recommend, approve, guarantee or introduce any third parties
or the service/products they provide on their web site, or have any
form of cooperation with such third parties and web sites. WTT is not
a party to any contractual arrangements entered into between you and
the provider of the external website unless otherwise expressly specified
or agreed to by WTT.
8.b Disclaimer of Warranty
To the extent permitted by law, WTT makes no express or implied warranty,
including but not limited to the quality or fitness for a particular
purpose or use, or to the legality, accuracy or completeness thereof.
8.c This clause 8 binds all users of the Website.
9. Governing Law and Jurisdiction
This Website and the use contemplated herein shall be governed by
the laws in force of the Hong Kong Special Administrative Region. All
users irrevocably and unconditionally submit to the exclusive jurisdiction
of the courts of Hong Kong Special Administrative Region
10. Notices
WTT will give you any necessary notices by posting them on the Website.
You agree:
(a) to check the Website for notices; and
(b) that you will be considered to have received a notice when
it is made available to you by posting on the Website.
